USCIS and CBP are cancelling pending asylum applications, particularly those filed within the last two years. This is how Trump is doing it:

Expanded Use of “Circumvention” and Expansion of Expedited Removal

The government has reinstated the broader use of expedited removal, applying it to individuals who cannot prove two years of continuous presence in the United States, regardless of their location. As a result, many affirmative I-589 applications, particularly those filed by individuals who entered after 2023, are being dismissed on grounds of ineligibility or improper venue 1

Even if they’ve been living quietly, paying taxes, and raising children deep inside the U.S., there's no courtroom, no evidence, no plea;  just an accusation of wrong venue and a countdown to exile. It's not immigration policy anymore; it's a purge.

Suspension of Asylum at Ports of Entry & CBP One Cancellations

Moreover, per Trump’s January 20, 2025, executive order, asylum processing at ports of entry has been suspended, resulting in the cancellation of scheduled appointments and interviews.2

Also, the CBP One program has been terminated, with previously scheduled appointments rescinded, including those made by prior procedures. As a result, thousands of individuals who arrived in the past two years have had their asylum claims effectively closed without further review. 3

This means thousands of individuals who arrived in the past two years are seeing their asylum claims cut off without warning; no hearing, no notice, just silence and removal.

Aggressive Courtroom Enforcement & Arrests at Hearings

If you haven’t heard, Asylum seekers are now being arrested during or immediately after their court hearings, often before the ink dries on their dismissal.

Show up to plead your case, Leave in shackles.

Some judges are expediting oral dismissals without full hearings, an outright euthanasia for due process under the guise of deference for alternative jurisdiction.4

Institutional Backlogs and Administrative Pauses

DOGGY’s "administrative pauses" due to fraud concerns are converting so-called delays into outright cancellations.5 These concerns are disproportionately affecting USCIS’ recent asylum filings.6

Targeting Anthropologically Vulnerable Groups

Activists, political dissidents, and climate migrants are the targets for visa revocation or asylum cancellation7

Who Is Most Affected? The Short:

Recent arrivals (within 2 years)

Those entering between ports of entry

Court-attending asylum seekers

The Receipt

Seek judicial review, file motions to reopen, or pursue withholding/CAT relief in court. We’ll discuss this in the upcoming podcast.8 But more importantly, this landscape demands strategic litigation, creative venue management, and immediate advocacy. Advocacy is essential. And advocacy is working. There is good news. I will be updating on incoming lawsuits and evolving policies that may restore access to asylum.

The arrest of Mahmoud Khalil, a Palestinian activist and lawful permanent resident of the United States, by Immigration and Customs Enforcement (ICE) on March 8, 2025, has made the news cycles—not about immigration law per se, but about how immigration law is being used as a tool for political messaging.

Khalil, a graduate of Columbia University's School of International and Public Affairs, was a leading figure in organizing pro-Palestinian protests at the university.

While he has not been charged with any crime, the circumstances surrounding his arrest suggest that this is not just an immigration case but a broader statement aimed at political dissidents in the United States.

Indeed, his detention without charges highlights a growing trend of using immigration law as a mechanism to silence activists, intimidate political dissidents, and send a chilling message to those who challenge government policies.

Historically, immigration enforcement has been leveraged as a tool for political suppression, particularly against immigrants engaged in civil rights movements, labor activism, or protests against U.S. foreign policy.

• The Palmer Raids (1919-1920): Immigrants were targeted for deportation due to alleged political radicalism during the first Red Scare.

• McCarthy-Era Deportations (1950s): Foreign nationals suspected of Communist sympathies were removed under politically motivated immigration enforcement.

• Post-9/11 Muslim Deportations: Hundreds of Arab and South Asian immigrants were detained or deported under national security justifications, despite no evidence of terrorism involvement.1

Khalil’s arrest appears to follow this historical pattern, wherein a ruling party utilizes immigration law to police political dissent rather than enforce legitimate violations of immigration status.

At this minute:

• As I understand it, Mahmoud’s immigration attorney has filed a habeas corpus petition challenging the legality of his detention.

• A federal judge in New York City has temporarily blocked Khalil's deportation while considering his case, with a hearing scheduled for Wednesday. ​

• We now know that he is being held in an immigration detention center in Jena, Louisiana.

In my attempt to connect with the younger crowd—who may have accidentally left the U.S. Constitution on read—I’ll be rizzing in some Gen Z lingo here and there. Stay tuned, it’s about to get “constitutional…”1

8 U.S. Code § 1324 has been gaining a lot of Rizz lately. The statute, in its relevant part, states:

Any person who…“knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation”

You already know the vibes.3 U.S. Border Czar Tom Homan has publicly accused Representative Alexandria Ocasio-Cortez of possibly “impeding” law enforcement efforts for her office's involvement in a webinar to educate immigrants on their rights against ICE agents. Tom has sought guidance from the Department of Justice regarding the legality of these actions.

Is advising my immigration clients on their rights against ICE agents a violation of 8 U.S.C. § 1324? The answer is Nah Fam.4 And a myriad of case law supports this if you don’t want to read beyond this.5

But that’s not the issue. The issue is do we want the smoke from the DOJ every time we advise a client that an ICE warrant is not a real warrant, to enter a private home, that a violation of immigration law is not criminal law, or, that the term Immigration Fugitive is something completely different from a Criminal Fugitive?6

Is the First Amendment even worth the fight when bad-faith government investigations are backed by Tech Oligarchy Overlords (TOO) tracking our every digital breadcrumb? This is not a new question.

In 1965, Supreme Court Justice William J. Brennan Jr. held that statutes are facially unconstitutional and are employed in bad faith to suppress protected activities. The Court opined that such misuse creates a "chilling effect" on free expression, deterring individuals from exercising their constitutional rights due to fear of prosecution.7

Indeed the Bill of Rights and the Constitution are not rights conferred to persons in the United States, but rather, it is a limitation of what the government can do to persons in the United States.8

So keep advocating, and keep fighting. Because the fight for Immigration Advocacy is the fight for the Constitution. Obviously, don’t say this verbatim unless you wanna hit mad-level cringe and make everyone internally scream.

Come Ye Weary White Afrikaners

On February 7, 2025, President Donald Trump signed an executive order titled "Addressing Egregious Actions of The Republic of South Africa," which directs the U.S. government to prioritize the resettlement of Afrikaner refugees to the United States, facing alleged racial discrimination and property confiscation in South Africa.9

Note: as of 2017, white South Africans, who constitute approximately 8% of the population, owned about 72% of the nation's private farmland.

Still, I don’t want to diminish the White Afrikaners, but I will anyway.

First, Asylum is meant for those facing persecution based on race, religion, nationality, political opinion, or membership in a particular social group (as per 8 U.S.C. § 1158). Afrikaners may face economic and political challenges. But, widespread, government-sanctioned ethnic persecution has not been officially documented at a level justifying mass asylum. White Afrikaners own the majority of land and businesses in South Africa. They are hardly considered stateless or without resources.

Also, Afrikaners are not the only group in South Africa facing economic hardships—why not extend this to Black and Brown South Africans suffering under the same policies?

Second, The U.S. has denied asylum to many other racial/ethnic groups, such as Rohingya Muslims, Palestinians, Uighurs in China facing arguably worse conditions.

Finally, the U.S. already struggles with immigration backlogs—adding a privileged group based on racial preference would be comical.

On the other hand, I love Chakalaka and Bab. And I love Bunny Chow even more. And arguably there would be more restaurants that would be serving them if the Afrikaners arrived here. So there’s that.

Let me reintroduce you to America’s taxpayer-funded, corporate-backed, no-bid contracted, industrial-scale prison machine designed to make rich people richer while locking up brown people for profit.1 All while the price of your cauliflower goes up.

Nothing about this is about national security or border integrity—this is about laundering taxpayer money while pretending to give a shit. And the looters are private prison executives, shady contractors, and every politician with a hand outstretched like a televangelist at a megachurch.

Here is the friendly definition for the terms you will hear in the next year:

1. No-Bid Contracts: The Government’s Favorite Ponzi Scheme - cutting fat checks to corporations who wouldn’t last five minutes in a competitive bidding process. GEO Group, CoreCivic, and fly-by-night security firms are already polishing their private jets in anticipation of their new cash injection.2

   Expect detention centers with billion-dollar price tags, third-world conditions, and “cost overruns” that will overrun into executive bonuses.
   

2. Detention Centers: The New Private Equity Goldmine. Locking up under-represented noncitizens will keep those stock prices soaring. Detention Centers will be Airbnbs for ICE, except the guests won’t leave, and taxpayers will be invoiced.
   
   Meanwhile, GEO Group and CoreCivic investors will be doing lines in their boardroom, before attending their corporate Whitney Museum Private showing while celebrating their “best quarter ever.”3
   

3. Deportation Resources: Invoicing Tax Dollars While Pretending to Work. ICE gets a budget increase more private contractors billing the government $10,000 a day for work that could be done by a traffic cop and a clipboard. Expect overpriced deportation flights and unnecessary overtime pay.4

The Money Laundering Machine:

Step 1: Taxpayer dollars are funneled into overpriced, no-bid contracts.

Step 2: Private contractors slash actual costs, and pocket the rest.

Step 3: They donate millions to politicians, ensuring the cycle continues indefinitely.

Step 4: The public gets sold the same “we’re securing the border” lie every election year, while nothing changes.

You will be paying for this. And you will be told that the real economic threat is undocumented farmworkers who pick your cauliflower for less than minimum wage—not the fact that a bunch of finance bros are siphoning your money faster than a crypto rug pull.

The Deportation Scheme is a multi-generational, industrial-strength, coke-fueled, tax-funded heist with a patriotic flag draped over it.

America: Privatized suffering is our brand of Economic Suffering.

As this Substack has consistently stated, Non-citizens and yes, Student Visa holders have the right to peaceful protest under the First Amendment, which protects freedom of speech, assembly, and expression. However, their immigration status adds a layer of complexity. In theory, Liu Lijun did nothing wrong constitutionally when she organized a peaceful protest at the UCLA protest.

Yes, you may argue about whether the protest was peaceful or not, but I would opine that it was objectively not unpeaceful.1

But the debate here is not about the limitations of the U.S. Constitution as it pertains to protest.

Neither are the other considerations of a student F-1 student visa-holder in debate here. Yes, Student Visa holders must adhere to their University’s Code of Conduct: Schools may have rules against certain activities that could impact a student's visa status if disciplinary action leads to suspension or expulsion. Likewise, the F-1 program prohibits students from engaging in unlawful activities (e.g., riots, property destruction).

Indeed, prior to Law School, when I was an F-1 student visa holder, we were not allowed to be on Academic Student probation, have long continuous absences, or date white women.2

And I should note: laws against protesting wars in certain Middle Eastern regions began under the Biden administration. It’s only that the Trump administration in full force decided to enforce such laws.3

Democrats incrementally forward laws that will provide them the least pushback, whether it’s passing a law they know will be overturned by the courts [every immigration law in the Biden Administration] while, Republicans will pass every law in mere mentioned amplified by a hundred times.

So what should Liu do? Not Much

In theory, she could challenge the revocation, by requesting Reconsideration from the U.S. Embassy/Consulate if she is outside the country. If she is in the U.S., she could challenge the determination through USCIS or ICE via her immigration attorney if there was no misconduct of University Policy - her school may also advocate on her behalf.

All while understanding that the Department of State has wide discretion in revoking visas.

If she is in the country and there is a subjective and objective prospect of harm should she return to China, then she may apply for asylum.

But there is a larger issue looming here beyond the First Amendment. Stretching the elasticity of our constitution for du jour politics can infer a nation of arbitrary laws. How will such instability manifest in this nation?

US Ends TPS for Venezuelans with the Assurance that President Maduro is No Longer Murdering as Many Anymore.

Kristi Noem is now the 8th United States Secretary of Homeland Security.

If you recall, Kristi Noem, the former Governor of South Dakota, shot her 14-month-old dog, Cricket, because Cricket had misbehaved during a hunting trip, and allegedly bit her. She also shot her family goat because he was aggressive.4

Anyway, Secretary Noem has determined that conditions in Venezuela no longer support the 2023 designation of Venezuela for Temporary Protected Status (TPS), and as such has ended TPS for over 300,000 Venezuelans.5

Former 7th Secretary of Homeland Security, Alejandro Mayorkas, previously in January 2025 extended Temporary Protected Status (TPS) for Venezuelan nationals for 18 months, citing "extraordinary and temporary conditions" that prevented their safe return to Venezuela.6

According to the State Department, the extraordinary and temporary conditions included significant human rights violations under President Nicolás Maduro's administration. The violations included: extrajudicial killings and arbitrary detentions, detention without due process, and some were subjected to torture.7

Other human rights violations included: suppression of political dissent, with over 2,200 individuals detained amid civil unrest, with many facing severe physical and psychological torture.

As a result, a significant portion of the Venezuelan population experiences severe food insecurity, and the public health system is in a state of collapse.

But within a month, Secretary Noem eliminated the program.8

Does that mean Venezuelans will have to go back? No. Not if Maduro is still in power, and the State Department deems him and his administration still as dangerous. Venezuelans may be able to claim asylum.

Under U.S. law, following the 1951 Refugee Convention and its 1967 Protocol, asylum seekers may seek asylum if they show a real and credible fear of persecution in their home country. They must also show that their fear is based on past persecution or a reasonable likelihood of future persecution.

It’s not straightforward, but the bones are there under international law. Ironically, this policy shift may push more Venezuelans toward asylum, making Green Cards more accessible through other legal pathways.

Still, whether you agree with Secretary Noem’s decision or not, these day-after revisions are just bad policy. If people believe laws are unstable or arbitrarily enforced, they are more likely to lose faith in democracy, leading to apathy or extremism.

Wait, that’s already happened.

What do Church raids actually mean, and a former client discusses a recent Kroger Raid where ICE wore Dr. Pepper Jackets asking for I.D.s

I’ll make two quick points because it’s relevant to this podcast and to this substack below. Excuse my lawsplaining.

First, non-citizens are persons under the Constitution.1 There is no ambiguity in this statement; no matter what your racist uncle says at the Thanksgiving table.

As such, non-citizens have certain protections under the constitution. They include: the right to remain silent and due process under the Fifth and 14th Amendments [one cannot be deprived of life, liberty, or property without fair legal procedures]. Non-citizens also have the right to free speech, religion, and assembly under the First Amendment.

Yes. Assembly. A non-citizen cannot be arrested for simply participating in a peaceful protest, again, no matter how your uncle chooses to Mericasplain the opposite to you whilst, now, eating all of your sweet sweet yams.2

More importantly, the Fourth Amendment protects non-citizens from warrantless searches by police or ICE. And, relatedly, the Sixth Amendment requires Non-citizens the right to a speedy and public trial [criminal - relevant to the Eight Amendment], while the Eighth Amendment, prevents the Government from issuing excessive bail and inhumane treatment.

Second, you should tell your Uncle, who is now eating all of your apple pie, that a violation of immigration law is a violation of civil and administrative law and not a violation of criminal law. It’s akin to jaywalking.

Yes, non-citizens still have to answer to other actual crimes if one has been committed, but, all of those aforementioned protections still have to be adhered.

So, Guantanamo Bay is not an option, the Riley Laken Act will likely be amended, and your Uncle will still not hear one word you’ve said at the table because he will assume that you’re a communist.

That’s the rant. Now the disclaimer:

The ICE Raids

ICE is not rounding up as many U.S. Citizens as Tik-Tok [Tic-Tac] will lead you to believe, but the aperture of who will be picked up will surely broaden.

The look of detaining only hundreds of non-citizens, many of whom with admittedly violent criminal records, looks particularly bad for an administration that previously contended there were over a hundred thousand illegal violent criminals roaming the free world. The roundup will expand in scope to include non-citizens with no criminal history.

But what rights do you have if you’re in the middle of one?

Here’s the short, if you don’t like my voice:

1. Don’t Run

2. Ask if you can Leave, and if you can walk away slowly

3. You have the right to remain silent

4. Ask to see a signed warrant from a judge - not an ICE official before you allow officers into your workplace or home

5. Do not sign anything before speaking to a lawyer or legal representative

6. Request a call to your lawyer or legal representative

7. Document or have your friend document everything

8. See point 5 again.

The Laken Riley Act

If you’ve read this far, you’ll know where I think this Act will end.

Never mind the U.S. - Mexico Border, the Trump administration’s abrupt decision to suspend the U.S. refugee resettlement program has left thousands canceling travel plans for individuals who had already been thoroughly vetted and approved for resettlement. This policy change effectively pulled the rug out from under refugees who believed they were finally on the path to safety, offering them little more than a bureaucratic shrug and a “better luck in the next presidential term.” or hopefully by the mid-term elections.1

Overall, an estimated 10,000 refugees have seen their resettlement plans evaporate, left to wonder whether the promises of safety and security were just elaborate window dressing.

The situation is particularly dire for Afghan refugees, including over 1,660 individuals who worked alongside U.S. military forces and unaccompanied minors. These individuals underwent rigorous vetting and were assured safety, only to find themselves stranded and vulnerable to Taliban retribution.

The sudden reversal serves as a stark reminder that even after risking their lives for U.S. interests, promises of protection are, at best, written in classic American disappearing ink.

Adding insult to injury, the suspension has shattered the hopes of families already residing in the U.S. who were eagerly awaiting reunification with loved ones. Despite having cleared every possible hurdle in the vetting process, refugees now face indefinite delays, as if the administration has mistaken due diligence for a big “oh well”

How does this policy make America Great Again? Will housing now be cheaper? Will Americans have better access to cheaper eggs now?

Possible Solutions

At any rate, having worked with Afghan refugees—particularly one grueling Afghan resettlement case that felt more like unraveling my second marriage—there is, in fact, a workaround.

In this weekend’s podcast; which I will also update here. I will discuss possible solutions and pathways for refugees stranded by U.S. policy changes, including legal challenges, humanitarian exemptions like parole, family reunification programs, and advocacy efforts through organizations and Congress.

I will also explore how third-country resettlement options and media attention can offer solutions, especially for high-risk groups like Afghan refugees, and examine the role of international bodies in providing temporary protections. John Stewart would be excellent in playing an advocacy role in this and we are in talks with him in this matter [we are not in talks with John Stewart in this matter.]

Also in this weekend’s podcast, I will address how to approach these Raids coming to a town near you. I am speaking partly in jest, as reports indicate that these raids may be limited to which cities cooperate with ICE.

What’s going on with the Boston Raids?

So, all media reports indicate that the recent ICE raids in Boston were targeted operations focusing on individuals with serious criminal histories. Those apprehended included a Haitian gang member with 17 criminal convictions - yes, the guy all over Tik-Tok [pronounced “tik-tak”] praising Obama and Biden -as well as individuals convicted of violent crimes such as sexual exploitation of minors and aggravated domestic assault. These raids are part of a broader strategy by ICE to prioritize the removal of individuals deemed significant threats to public safety.

So far so good. It looks like the raids are optics to appease the “Make America White Again” crowd while preserving the very real reliance the U.S. has on Migrant workers.

But then this:

But I digress, indeed, Migrant workers make up over 70% of hired farmworkers in the U.S., according to the USDA. Some, including Mary Jo Dudley, the director of the Cornell Farmworker Program, cited in Jennifer Bamberg article from Agriculture.com estimate:

“If we lost half of the farmworker population in a short period of time, the agriculture sector would likely collapse,” Mary Jo Dudley, the director of the Cornell Farmworker Program, told Investigate Midwest. “There are no available skilled workers to replace the current workforce should this policy be put into place.”2

Soylent Green is people, and Soylent Green is People…

The Skinny (Literally):

The Indian government is teaming up with U.S. authorities to pack approximately 18,000 undocumented Indian nationals onto flights back to India. The move is an attempt to stay in the U.S.'s good books and preserve the golden goose that is the H-1B visa program, which has been the lifeline for every aspiring tech bro dreaming of Silicon Valley stardom.

Higher than 18,000: The Real Headcount

18,000 is just the appetizer. The actual number of undocumented Indians in the U.S. is closer to 725,000, according to Pew Research. That makes Indians the third-largest group of undocumented immigrants, right behind Mexico and El Salvador. It’s essentially a population large enough to pack an A.I. conference in Las Vegas1.

Nothing New Here, Folks:

India and the U.S. have been playing this game for a while. Back in October, Under the Biden Administration, over 100 Indians boarded a flight home—all of them with one-way tickets courtesy of U.S. immigration authorities. The Modi government is treating this partnership like it’s a diplomatic fast yorker2: stay friendly with the U.S., protect the H-1B visa program, and maybe throw in a little trade talk while they’re at it. It’s a win-win for everyone—except of course for the “18,000” people being sent home.

The Indians:

The Trump administration purportedly has identified Indian nationals scheduled for deportation.

• Deportation Orders: These will likely include individuals who have deportation orders, as opposed to being in removal or deportation proceedings.

• Undocumented Status: These individuals are part of the larger group of Indian nationals living in the U.S. without any legal status.

• Overstayed Visas: Those who have entered the U.S. legally (e.g., on tourist, student, or work visas) but overstayed after their visas expired.

• Recent Uninspected Arrivals: who have entered the U.S. irregularly in recent years, often via human smuggling routes through Mexico.

• Undocumented Status: Get documented: Look up lost USC family members,
  revisit your country’s conditions, and talk to a Lawyer. Lawyers can dig into your history to see if you qualify for immigration relief. Get in the DHS system.

• Overstayed visa: examine if waivers apply that may address your overstay.

Hello, and welcome to my little corner of Substack where we explore immigration policies under the Trump administration—arguably one of the most “creative” periods in U.S. immigration history (if “creative” can be stretched to mean chaotic, restrictive, and often absurd). I’m an immigration lawyer who spends a significant portion of my time trying to make sense of it all—so you can read this, ignore me, and still spend a significant portion of your time trying to make sense of it all.

I started this Substack because I see firsthand how these policies will disproportionately impact the most vulnerable around me. Many of my clients are navigating systems that seem designed to confuse, delay, and demoralize.

But this isn’t going to be a fatalistic doom and gloom-scroll blog. No, no. I promise to mix a little levity with the legal, because while the system is a hot mess, there are still opportunities to find solutions, loopholes (legal ones, I promise), and pathways forward. Think of this Substack as part survival guide, part coping mechanism, and part rallying cry.
